Terms of Service for Clear Eats

Please read these Terms of Service ("Terms") carefully before using the Clear Eats mobile application (the "Service") operated by Clear Eats ("we", "our", or "us").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree with any part of the Terms, please do not use the Service.

1. Introduction
Clear Eats is a mobile app that helps users understand what's in their food by analyzing ingredient lists and brand reputations. Our mission is to make food transparency easy, accessible, and secure.

2. Privacy Policy

3. User Accounts
Some features may require you to create an account or subscribe to a plan. You agree to provide accurate information and are responsible for maintaining the confidentiality of your login credentials. Please notify us of any unauthorized access.

4. Use of the Service
You agree to use Clear Eats only for lawful purposes. You may not:
  a. Use the app to spread false or misleading health claims.
  b. Reverse engineer or misuse the AI or image processing system.
  c. Upload harmful content or viruses.
  d. Bypass subscription systems or misuse free-tier limits.
  e. Use automated bots or scrapers without written permission.

5. Image Scanning and Data Processing
a. When you scan a food label, the image is processed through third-party AI services.
b. Scanned images are used temporarily (ephemerally) for analysis and are **not stored** on our servers or by our providers.
c. Only the **scan results** (e.g. ingredient breakdowns and alerts) are saved — and **only locally on your device**.
d. You are responsible for backing up this local data if desired.

6. Subscriptions and Billing
a. Certain features may be available only with a paid subscription.
b. Payments are securely processed via your app store provider (Apple/Google).
c. Subscriptions auto-renew unless canceled before the end of the billing cycle.
d. You may cancel anytime via your app store settings.
e. Subscription fees are non-refundable except where required by law or due to technical error.

7. Intellectual Property
The Clear Eats brand, app design, and food scoring system are the intellectual property of Clear Eats and its licensors. You may not copy, modify, or distribute our content without permission.

8. App Availability
We strive to keep Clear Eats available at all times but cannot guarantee uninterrupted access. Downtime may occur due to:
  a. Scheduled maintenance
  b. Third-party outages
  c. Technical issues
  d. Force majeure events

9. Termination
We may suspend or terminate your access to the Service at any time for violating these Terms. Upon termination:
  a. Your subscription will be canceled.
  b. Your local data will remain on your device unless you delete it.
  c. Terms related to liability and intellectual property will continue to apply.

10. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind. We do not guarantee:
  a. That all ingredients or additives are flagged accurately
  b. That scan results are complete or medically validated
  c. That the app is always error-free or uninterrupted

Use the app at your own risk and always consult medical professionals when making health decisions.

11. Limitation of Liability
To the extent allowed by law, Clear Eats is not liable for:
  a. Loss of data on your device
  b. Inaccurate or incomplete food risk analysis
  c. Health outcomes resulting from food choices
  d. Indirect or consequential damages

Our total liability is limited to the amount you paid for the Service in the last 12 months.

12. Governing Law
These Terms are governed by the laws of the United States. Any legal disputes will be resolved in the courts of the United States.

13. Changes to Terms
We may update these Terms from time to time. If changes are material, we’ll notify you via the app or email at least 30 days in advance. Continued use of the Service means you accept the new Terms.
